FINAL MINUTES OF PUBLIC MEETING

 

Board members present: Bruce Kullgren, Sr., Rae Barnhisel, Allan Pickman, Richard Whitcomb and Ex-Officio Tedd Petro.

 

Call to order by Kullgren at 7:35 p.m.

 

1.  Public hearing for Richard Messina, M 08 L 008, Route 101, for site plan review. Richard Whitcomb recused himself from the hearing because he is an abutter to Mr. Messina. All abutters were notified and receipts returned. Donald Andersen was the only abutter present.

 

The Board read through the checklist from the May 7, 2003 minutes – Section 4 Submission

Requirements: A. Existing Data and Information, and Section 4 Submission Data: B Proposed Development, from the Site Plan Review Regulations.

 

Part A # 3 – 2 mylars and 4 copies of plans needed.

Part A # 8 – by comparing the vicinity sketch with the DES approved septic design plan, it was

                   determined that the proposed System B septic system is at least 90’ from the Stark’s well.

Part B # 5 – The plan shows the location of trees to be planted but does not specify the size or type. 

                   Pickman suggested adding a note to the plan that would say “trees to be planted per ZBA

                   Decision of 1/9/2003.”

Mr. Messina said that he is also planning to plant six trees along the front of his property – one every 12’. Health Officer Peter Caswell suggested that since these trees will be very close to the existing septic

system for the house, Mr. Messina might want to choose trees that do not have wide spreading roots.

Part B # 7 – Pickman pointed out that Mr. Messina has his cabins as close as 15’ to each other and he

                   believes that the Int’l Bldg. Code requires that the cabins be constructed out of masonry, or

                   some other non-flammable material, if they are within 35’ of each other. Mr. Messina did not

                   want to reconfigure the cabins to avoid this requirement. The clerk was asked to contact

                   Code Enforcement Officer Will Wildes to determine what the exact requirement is. Pickman

                   suggested a condition of approval that  cabin construction must meet Int’l Bldg. Code.

Part B # 10:

There was a discussion about which septic system plans the state has approved and how long are they

approved for. Mr. Messina said that he currently has a DES approved plan for one system that will service the whole property, to be located in the north west corner behind the shed. He has had this four-year approved design for about 2 years but did not have the plan with him. He said that he has another four-year approved design for a system that would service the cabins only. This system was approved on

1/6/2003 and is known as System B, #CA2003049715.

He had a 90-day approval for a system to serve the house – System A, also approved on 1/6/2003, but since both Meridian Land Services and Health Officer Caswell felt that the current system was not in failure, Mr. Messina did not install this system. He said that he will resubmit the design for System A to DES, and ask for a four-year approval, so that if the system for the house does fail he will have an

approved plan ready to go.

Petro and Barnhisel pointed out that in the May 21st minutes, the Board had asked that the letter from Health Officer Caswell, stating that the current septic system for the cabins is functional, be presented

prior to the public hearing. Mr. Caswell didn’t know where the letter was.

Part B # 10 – Written statement from Health Officer Caswell, stating that the current septic system for the cabins is functional, is needed.

 

Kullgren said that the Board would need to see an approved four-year septic design to service the house,

in case the current system fails. Barnhisel agreed and read Section 5, K ,of the Temple Site Plan Review

Regulations which states that State septic plan approval must be given before site plan approval can be

given by the Planning Board.

MOTION:      Kullgren moved to accept the application, second by Pickman. 3 voted in favor and

                   Barnhisel abstained.

Abutter Don Andersen asked if the septic design that was approved in January 2003 was based on the

old site plan, with 8 cabins, or a new site plan showing 6 cabins. Kullgren said that the septic plan

shows 6 new cabins and shows cabins 7 & 8 to be razed (removed).

Petro suggested that a note be placed on the plan that references septic system design A, and states

that the 90-day approval for that plan has run out. He would also like to see the two septic plans that are drawn on Mr. Messina’s plan, marked “A” and “B” on that plat, so it is clear that they reference the two

septic design plans A & B, that  were approved on 1/6/2003.

Board members seemed to agree that even though septic system A is no longer approved by the state,

since it’s design was approved, it could receive approval again if the existing system fails. The Board

asked Mr. Messina to mark the two systems “A” and “B” and to insert a statement saying…”system A can

be built if the existing leech field for the house fails.”

FEES: $80 due to the Town of Temple

           $26 due to the Hillsborough Registry of Deeds

The hearing was closed at 9:15 p.m. The case will continue on August 6, 2003.

Pickman asked to see the Consent Decree between Mr. Messina and the Town because the ZBA

Decision Notice states that Mr. Messina must demolish cabins 7 & 8 within the time period specified in

the Consent Decree, and he wanted to know when that was. The clerk made copies and it was discovered that the cabins were to be demolished within 180 days of the ZBA Decision dated 1/9/2003,

which means that the cabins were to have been demolished by July 9, 2003.

2.  Review of July 2, 2003 minutes. The Board wanted clarification about #3, sentence 4. Move by

     Kullgren to approve the minutes as amended, second by Pickman and voted in the affirmative.

3.  Kullgren said that information regarding Transportation Enhancement funding came from Southwest

     Regional Planning. The grants can be used to improve transportation safety for pedestrians, bicyclists,

     and autos.

4.  Barnhisel pointed out that some of the basic studies language in the latest Master Plan draft is

     incorrect. She will bring her notes to go over this at the next meeting.

5.  Move by Petro to adjourn, second by Barnhisel, meeting adjourned at 9:40 p.m.
