ZONING BOARD OF ADJUSTMENT

November 5, 2002

FINAL MINUTES OF PUBLIC MEETING

 

VOTING BOARD:      Don Kraemer, Silas Little and Nate Chamberlin

CALL TO ORDER:     By Don Kraemer at 7:35 p.m.

Mr. Kraemer read a letter of resignation from Will Phillips. Mr. Phillips moved out of Temple and thus had to

resign from the board.

MOTION: Mr. Little moved to accept the letter of resignation, seconded by Mr. Chamberlin and all were in

                  favor.

Minutes – September 5, 2002

MOTION: Mr. Little moved to accept the 9/5/02 minutes as written, Mr. Chamberlin seconded and all were

                  in favor.

Scheduled to be heard this evening:

Case #2002-9  Lisa D. Beaudoin (Herban Living Bed & Breakfast) applicant, and Lisa Boudoin and John W. Friede owners, have applied for a special exception under the terms of Article IV, Section 20 of the Temple

Zoning Ordinance, to permit the operation of a bed & breakfast on Lot 6-060, 242 General Miller Highway

in the Rural Residential and Agricultural District.

There were only three board members present. And although three members make a quorum, Silas Little is an

abutter to the applicant and felt that he must recuse himself from hearing this case. He read RSA 673:14 which explains why he is disqualified from voting. He also explained to the applicant that she must have three

affirmative votes from the board of adjustment in order to be granted relief. So it is to her advantage to have a larger board hear her case. He read RSA 674.33 which states the statutory requirement that there be three

affirmative votes.

Ms. Beaudoin paid the Town $10 to cover the expense of notifying two additional abutters. She was also informed that she needed to provide a sketch of her property with the locations of the house, garage, parking

areas etc.

MOTION: A motion was made to continue the hearing to the December 5th meeting. Two were in favor and

                  Mr. Little abstained.

It was hoped that the Selectmen would appoint one or more new members to the board by December.

MOTION: Mr. Little moved to adjourn the meeting, Mr. Chamberlin seconded and all were in favor. The

                  meeting was adjourned at 8 p.m.
