OLD BUSINESS
MINUTES – 1/2/03
MOTION: Mr. Little moved to accept the 1/2/03 minutes as written.
Second by Mr. Fonda and all in favor.
NEW BUSINESS
Case # 5/1/2003-1 RICHARD MESSINA
Richard Messina (Temple Cabins) has applied for special exceptions under the terms of Article VII,
Sections 2 and 3 of the Temple Zoning Ordinance, to permit, pursuant to the Superior Court Consent Decree,
the expansion and relocation of six cabins on Lot 8-8, NH Route 101 in the Rural Residential and
Agricultural District.
Attorney Bobbie Hantz represented Mr. Messina.
Mr. Little explained that the board approved this application for special exceptions, with certain conditions, at a hearing held on January 2, 2003. One of the abutters was not notified of that hearing because Mr. Messina
provided an incorrect address. Mr. Messina asked the board to rehear the case this evening after sending out
abutter notices to current correct addresses. Mr. Little then suggested that since the applicant was not
requesting anything different than the request made in January, that the board re-adopt the decision previously
made.
Board members looked at a new septic plan, sent to the Town by DES in January 2003, which showed the
leech field on the western edge of the property, abutting the Stark’s property. The Stark’s well location
was not shown on the septic plan, but the board assumed that Health Officer, Pete Caswell, checked to see
that there was the necessary distance between the Stark’s well and the proposed septic system.
MOTION: Mr. Little moved to approve the application on the same basis that the board approved the
application in January, 2003, as it is the same application and the board imposes the same
conditions as were imposed then. Second by Mr. Chamberlin and all were in favor.
Mr. Messina did not pay the $45 application fee when he submitted this application so Attorney Hantz
agreed to send a check to the Town.
